but you said Carl wouldn't invest $16 million on a plant with out a patent and risk so much of shareholders money.

So how does this solve the IPR issue?

It actually shows more that Carl needs a big company to buy him out more than anything else.

Someone who actually has the money to move fast enough to squash any competition.

But then again if there is no patent why would they need to deal with Carl..

The best thing Carl has going for him is that he can sell a shell to a non-public company that has a highly promoted grass that might not have a patent.
