OK, "air shares" term is reserved for naked shorts. Make it "unregistered", which means they have nothing to do with official AS number. Aurus didn't legally issued them, they are not counted anywhere, it's an "air" :) As to suing "old management" (or some insiders) for selling unregistered shares, I know at least 2 examples: one with no results (Star Energy) and one successful (Siberian Energy). The second one was in much smaller scale though ("misbehavior" of some insiders). In general, it's very time and cash consuming. Much cheaper and more effective is to start new clean history from scratch - buy a new shell.
