This subject of the MMs having the legal right to sell shares they do not have has been debated to the max on this forum. Do they do it ? YES. Did they do it on KATX ? Probably. Have they over-done it ? Quite probably. THIS is my point. We will never know the severity of how they abused their shorting rights on KATX. I think we are seeing a general clean-up right now. If it is the MM s covering their old undelivered sells they probably have won big time. It may be harder from here on when the new enforcing rules come in. As far as Naked Shorting goes .. None in my opinion. The MMs have the legal right to sell what they can't deliver but it's the abuse of the time frame to cover that is now being tightened up. If I was a KATX Shareholder right now I would be concerned that there is still that sizable volume still coming out on the sell side. SOMEONE is STILL dumping.
