1. The defendant, Panetta, was sentenced by this Court on January 14, 2011 on counts one and two to run concurrently, to a term of 36 months probation, a $75,000.00 fine; and a $100 special assessment.

2. With the consent of the government and the probation department, counsel hereby respectfully requests that the payment terms of the $75,000 fine imposed in this matter be amended as follows:

3. If not already paid, the defendant shall pay $40,000 immediately. The defendant expects to pay the $35,000 balance by January 14, 2012. Should the defendant fail to pay the balance by January 14, 2012, statutory interest will accrue on any remaining balance starting on January 15, 2012. In any case, any remaining balance and interest shall be paid in full no later than January 14, 2014. Starting on January 15, 2012, the defendant shall make equal installment payments, as set by probation, on any remaining balance on a quarterly basis, with payments due on January 15, April 15, July 15, and October 15 of each year until paid in full.

4. For all the reasons set forth above, counsel respectfully requests that this unopposed motion to amend the schedule of the defendant’s payment of his fine be granted.
