I'll bet that supposed shareholder is quite happy that his 50 million shares that were worth $90,000 at the open of trading on
3/23/10, are now worth $5000.
If he still has plans for a tender offer at a 25% premium to market valuation, at least he doesn't have to worry about the
maximum cap he put on his offer, which would now be .000125.
