My conclusion is that TEVA does NOT know whether tL will be approved, denied or studies required. Thus, they cannot tell us.
TEVA has painted itself into a corner where they will need to tell us what happens after they hear from the FDA.
As DD has pointed out, the suit has given TEVA more to think about. That could be the entire reason for the shift in tone by Marth though I doubt it. Rather it seems there has been a recognition by TEVA that tL may NOT be heading for approval and they are preparing the market for the change.
So the big change, IMO, is that the tL cloud overhanging MNTA may disappear far sooner than I expected and in a more conclusive manner. I could see the work list that pgs suggested taking the form of a suggestion that TEVA start over ala Amphastar. Couple that with TEVA doing so and the patent suit by MNTA is premature/moot.
