That questionable lawsuit would seem to give MNTA cover for this offering. After all, Teva's going to launch any day...

As we now know from Teva (at least I think we do) Teva has no tlovenox in the United States with which to launch a product, even if they did gain approval. So imminent does not appear to be any party's expectation, albeit, an FDA action on the issue could come at any point in time, or never, but that is nothing new.
