Zip and North, assuming TEVA doesn't cave and voluntarily withdraw their ANDA (not likely) what is a reasonable approximate time line for litigation like this to run to resolution?



It depends on the course this takes. North seems to think that the suit may be premature, which if correct, could result in dismissal within a few of months. (He has likely forgotten more than I ever knew about this subject but I would guess that the suit will not be dismissed as premature.)

But if dismissed as premature, that would not be the end and the suit would immediately start over if FDA approved tL.

Once the issues are joined, I would think it will take 18-24 months to district court judgment and another 6-8 months for the Appeal.

The interesting question is what will TEVA do during the litigation. Launch? Wait?
