Sandoz is the exclusive licensee of the '866 and '466 patents.

IF those patents are being infringed and it could cause them to suffer billions in damage, why wouldn't they join the suit?

My opinion for the record:

- the suit MAY be premature;
- the suit MAY NOT succeed;
- but I do NOT accept that it was filed for tactical purposes without having arguable legal merit.
