If as has been extensively speculated here, Teva used another companies product in partnership, filed two years prior to mnta, how is it possible they could be infringing?

Here is how:

The tL being offered met the sameness criteria when filed. But Teva could not SHOW that without the use of the patented techniques.

(I am NOT saying I believe that is what is happening.)
