Yes, agreed. But the infringing stockpile raises an interesting question wrt the ItalFarmaco/Lupenox theory espoused by Dew. Would the process for making Lupenox infringe any Momenta patents?

I would say probably not, since Lupenox was introduced over four years ago, and thus t-enox is not Lupenox. What say you to that, Dew?

Edit: the 466 patent was filed in January of '08. The 866 patent was filed in 2003. Hard to argue the former was infringed by Lupenox. And Shea said patents, plural.
