Well just to be clear, it pretty much has to be something of a shot in the dark given that MNTA presumably has no actual knowledge of the techniques Teva (or its partner) are actually using, and hence can't know for sure whether Teva is infringing or not.

But I'm not suggesting at all that filing this suit now is not therefore a good strategy - far from it. I think it's a very smart move.
