My best guess that they feel that it would less harm done to withdraw than to chance an unfavorable decision. They were cautious not to announce the hearing date back when it was set for the same reason. I'm also guessing that they will pull the trigger on the option that would otherwise expire on 12/9. I believe this is a sign that they plan to move forward.
