The following message was posted yesterday on another board. I think that it brings up some interesting points about the confluence of today's political scene with a possible Teva strategy.

While TEVA is clearly lacking in technology in comparison to MNTA they take a back seat to no one when it comes to legal representation and lobbying.

I strongly suspect a carefully worded lawsuit is close to being served against the FDA regarding the MNTA approval while TEVA's application is still pending. The ever increasing short position is a real tell that something big is in the works. I'll venture these shorts are closely allied with TEVA and know that a 10 ton anvil is about to fall on MNTA's head that is going to give MNTA a serious headache for a considerable length of time that could easily last for several years.

TEVA's strategy is pretty obvious as they have been discrediting the FDA since MNTA was approved while looking to Congress and Govt. Oversight Committees for help. I will not be surprised if SNY has been asked to join the suit as well along with perhaps Amphastar. They all have a 'dog' (pun intended) in this fight and with such HUGE money at stake for all involved they will do and say ANYTHING to get what they want.

MNTA has developed disruptive / game changing technology for FOBs and whenever disruptive technology comes along the lawsuits, lies and slander follows. We have all seen this in the technology sector as a company such as QCOM has been sued by just about everyone as their CDMA technology threatened to displace GSM which it is well on its way to doing........ but not before having everything including the kitchen sink thrown at it for over a decade now. All the lawsuits and lies against QCOM did serve a purpose and that is it slowed down the deployment of CDMA and gave additional life to the GSM players while weakening QCOM.

MNTA is guilty of nothing......... yet I fear they are about to be slandered and made to look like the bad guy for simply developing the best technology and 'building a better mouse trap' while saving countless lives by solving the Heparin puzzle about 3 years back. So yes, of course the FDA looked 'favorably on MNTA' as solving complex issues while saving lives always results in 'favorable treatment' (see: 'Sully Sullenberger' of "Miracle on the Hudson" fame who saved over 150 lives by safely landing a US Airways Airbus A320 on the Hudson River). 'Sully' has received 'favorable treatment' ever since..... and for good reason. The same way the FDA views MNTA 'favorably' as they to saved lives and resolved a complex problem that no one else was able to resolve.

Nonetheless, the tea leaves say TEVA is going to come after MNTA with a lawsuit against the FDA based on recent 'news' releases in the WSJ. Strategy is pretty straight forward...... discredit the FDA and bring on a witness or two from the agency that will testify that indeed MNTA received 'favorable treatment' from the FDA which has already taken place........ and soon catch phrases like "corrupt Govt. agency" will be commonplace among many in the newly elected Congress. Bashing the Govt. at every opportunity is what today's GOP lives for and their electorate eat it up even when it has little validity. Ignorance reigns supreme when an agenda is being forwarded. You can already hear the crys for a Congressional investigation into the MNTA approval while TEVA has been discriminated against by a corrupt Govt. agency.

This will be a HUGE pinata to swing at as the waters are already being chummed by TEVA. True, it's both ignorant and wrong....... but it plays well to many members of the new Congress which is all about winning elections and pleasing their anti-govt. base..... the choir they preach to will all nod in unison at the crys of "Govt. over-reach and corruption" etc. It's the perfect case to kick off the new Congress and why I believe it is coming, unfortunately.
