My feeling was the agreement was specific to the INFORM study. Perhaps I misunderstood.

Yes, the relevant agreement is the one between Roche and ITMN in 2006 (#msg-55244797), which is well before any agreement pertaining to the INFORM study and otherwise pertains solely to ITMN.
