Since the Court already rejected Teva’s attempt to add additional non-Orange-Book patents to the lawsuit against NVS/MNTA, it’s reasonable to presume that the Court will not allow any other patents to be admitted into the suit at this point in the process. Therefore. the nine patents at issue in the lawsuit are the only ones of concern for MNTA unless the District’s Court’s ruling on the inadmissibility of additional patents were to be overturned on appeal.
