IMO If there was going to be a retraction due to a settlement, I would have expected to see it today. Why risk going into court and having an negative outcome?

Playing "chicken" with an adversarial party that is likely disgusted with getting jerked around is a dangerous game... unless you do not have the ability to resolve the debt, the belief in a successful drilling program is questionable or "Plan B" is so spectacular that you can leave the $50 billion of oil (per EEGC press releases... not my estimate) in the ground for some other party to exploit.
