Was there anything to stop "Mr Big" from trying to control virtually 100% of the outstanding 53.7MM shares so long as no individual or entity owns 5%?

Reason I ask is it seems by letting "us" own between 7.5MM and 9MM shares (best guess)he appears to be leaving money on the table.
