Could SNY press for a trial at the district level to force a ruling on the merits? Or what?

Absolutely, SNY can go forward with a trial. In fact, that appears to be what they say today that they will do. It might be the best case for MNTA, since FDA may be hesitant to deal with the other applications until the court rules on the law suit (though I really doubt that the FDA will wait that long for that reason).
