SNY's interpretation of the statute is joke, the moment the judge reads the statute he will laugh at SNY's argument. Sanofi's lawyers better watch out that they don't get hit with sanctions under Federal Rules of Civil Procedure Rule 11(b) ...

I suspect that when/if we know, it will turn out that FDA handled trade secret data behind a Chinese wall. Even if it was not, FDA is not going to come out and say that it was a meaningful part of the analysis upon which they made the decision. (But you made fine arguments that are respectable, even if they are losing arguments.)

BTW - while I would use more muted terms that Mpower, I do not see the SNY case except in a very technical sense upon assumed facts that likely will not prove out.
