For the sake of discussion, if UTRM is ordered to pay (only) GSK's legal fees and expenses, such an amount would indeed be massive to a company with negligible revenue and no announced sales of their only product.
Add to the above their own legal fees and it gets worse.
In fact, if they have to pay just those items, IMO it could bury UTRM.
GSK claims that UTRM didn't follow through on their commitment to abandon their use of the Aqua... logos.
Had UTRM abandoned their use of these logos, GSK would have walked away and not commissioned the $56,000 consumer opinion survey.
I suspect a judge will review the letters from UTRM's counsel and reach the same conclusion as that reached by GSK's counsel.
