In my opinion again....
Permit- Maybe. It's not hard to get. I would guess that the only reason it's not done already is that it would force the company to disclose the next hurdle.
Produce and sell- not any sustained production and sales. Since JBII hasn't given any unambiguous evidence of value or commercial viability, I would bet my bottom dollar there isn't any. If that's true that it can't be sold profitably, a company won't do any sustained production and sales even if doing so would put on a good show for investors--too much money goes out the door.
That said, I have seen penny companies pretend that full production and sales were in full swing--but a quarter or two later of filing they show they were dishonest in the filings and their chances of being sued seem to go up substantially--usually by noteholders or others. I haven't seen common shareholders sue very often.
