The speculation is that it will be a fixed price in the mid 20s. As for the buyback, one theory is that they need to raise money to continue the expensive litigation, but they think the stock is too cheap and do not want to issue new stock to do so. So, they buy back 4 million shares at 18 with the 75 million. Seems sort of like they are selling 2010 leaps on the stock...
