It has been posted on this board by another that THJMW has in the past awarded 'damages' in BK cases. I may be using the wrong term when asking you about 'damages'. At any rate, if I understand you correctly, there will be no award in this case, IYO, yet SS likely will call for consideration of damages during negotiations. And 'damages' may be factored into a settled upon dollar amount, without the amount being specified / labeled as 'damages'?
