IF they are following standard buyback rules (which I don't believe they have to as a pink sheet) they can buy at the bid OR the ask. However, if they buy at the ask it has to be AFTER a previous buy at that same price. The rule requires that the buyback NOT cause an uptick. Buying at the ask, however, is fine.
