The judge doesn't believe he's the one to decide. He's the one who we,society, the government, legal system, whoever, have given the job of decider. Again it's his job, not belief, or hope, or fantasy, JOB. I agree that where we are is what is the value of this company. I also agree that at some point it maybe worth while to have an independent entity give there view of what that is.
I agree with the judge that now is not the time for that. It's not the time for that because: 1) It will take time for whoever to get people together, one person doesn't do this, get an office up, then go through the process of evaluation, etc. 2) Now whatever the Examiner says, every one is gonna scream and trash it. There'll be tons of motions and briefs which will just take time and cloud the issue.
Much better, as the judge has laid out, for them to slug it out in open court. Either one side will conclusively prove that they're right and the other guys are idiots, in which case the judge just endorses the obvious, or they all either look like: 1) idiots,thieves; or 2) equally credible people. In either of those cases it then behooves the judge to have an independent party give an opinion and, and, and, he may well be able to have the parties agree to the findings as part of the order of appointment, which puts an end to all the nonsense.
