I do agree with you that the best body to decide about the company's valuation would be a third party expert. Actually I have no doubt about it. And I am almost positive that judge Sontchi believes that as well. I would be very surprised if he didn't.
But I am also convinced that the him going the way of actually having an examiner appointed had a possibility of +/- zero. He heard one side, he did not hear the other. Now he will hear both sides, and he will either make up his mind, or - if he can not - he will consider appointing an examiner to have a better feel for the valuation of the company.
This is - of course - my own, personal opinion, and it is worth precisely as much as you paid for it...<grin>
