At first, I was extremely upset about the way this went down. That is strange because shortly before the meeting started I had made a comment that I would have preferred to have Susman as the independent Examiner. Well it looks like I got what I wanted, so why was I so angry? I was angry about the way the judge went about delivering her decision although it was precisely what I wanted. I have read the posted transcribed decision from the judge and still think there must have been a better way, though I do not know what it would have been.
She gave the EC the same basic powers as the Debtors, I am sure that had to make them happy. But what I did not see from the judge was the ability to go deeper in the investigation, perhaps it was there and Susman is expected to take some sort of obscured clue. She did not appear to allow a deeper investigation as it appeared she had in the same breath limited the EC to the same information that has already been through discovery. Perhaps Susman can narrow down the further request for the rule 2004 discovery to a level the judge will accept and still be beneficial to the cause. I still have high hopes for the commons and wish now that I had sold more yesterday as it will now surly take some time to recover and I could have rolled it into another 1/4 increase on the number of shares.
