It’s a safe bet that AGN’s top executives have discussed this article in the company’s war room and are already taking corrective action. If they are deemed to be facilitating illegal use of the product, the potential fines could easily outweigh the income from the incremental sales.

On the other hand, merely being aware that illegal activity is going on is not the same as being a facilitator. If AGN’s sales reps are assiduously sticking to the FDA label and telling their accounts that Latisse must be dispensed by a licensed MD, the company probably can’t be held liable for the botched results stemming from illicit use.
