As for the new judge, one has to take into account the sitting judge sent a resignation letter to Barack Obama.

This means there is a vacancy in this district, which means Obama has to make another appointment.

The sitting judge that had all this handed to her, for lack of a better description, probably already had a full plate of cases to deal with.

Maybe the new judge isn't particularly interested in the case and will prefer to continue it until Obama appoints another judge for this federal district who will take it on.
