No, it's just a revision in the risk-reward balance in light of the motion to dismiss in the IFX case. The truth is that we all know Payne is out to get RMBS (not because he's corrupt, but because he long ago decided who the good guys and bad guys were...). Since everyone kind of expects partial summary judgment in RMBS' favor in the Hynix case, that may have already been discouunted when this latest motion hit.

Most of us fully expect Payne to rule against RMBS and for us to get back to the Court of Appeals again. The real wild card is the FTC...
