It was KD, gung ho on Poken, who tried to flex muscle to buy up Poken, while Cole, Boyne (and Bentley) saying, "No way, that's outside our business model." KD, per wm's "blackest of hats", at odds w/ Cole over "who's the boss", brings in SEC cuz had no access to cash cuz Cole & co. stashed it, knowing that its gonna be needed for various startup deals (ChinaLot, Thomas, etc.) Now KD stuck between SEC and lawyers, looking for a way out, without perp walk?
