I don`t believe you can patent something that you stole :)
Otherwise coca-cola would be risking their entire empire.
More on my previous post -- biotechs come up with FDA approvals that get legally allowed generic competitors a few years later but they get rich anyway during that window of monopoly. And other countries steal their drug long before then.
