Answer no! This has to do with the delicate laws that pertain to how distributors of alcoholic beveridges sell to, deliver, credit and advertise their brands to said retailer. At Columbia we are clearly told that because we sell alcohol, we cannot by law for example, give tickets to the game for a floor stack of Coors Light; cannot give a bar a neon sign of Sierra Nevada if this bar gives us a tap handle of Sierra Nevada or any other of our brands; we cannot pay them X-amount of dollars for an end cap display or extra shelf in cooler; we cannot put money into any retailers business of say paying for a new tap system and then expecting to get additional tap handles from this service; we cannot require any retailer/bar to have any quotas of any kind with our products as part of a 'deal' on a discounted price - ... and it goes on and on.
Becasue we sell beer, wine and spirits, the laws are VERY stringent. Basically, deals like above have and do happen - but those retailers and those distributors are knowingly breaking the law and put no less than their entire business or liquor license in jeapordy...usually deals like this happen with newer salespeople who were not aware that they cannot influence any retailer with 'gifts, promises, quota, deals' of any kind on their own.
I know of one QFC where a manager was on the take for years - tickets, gift certificates, many cases of 'samples' - he lasted incredibly 10 years but it caught up with him finally - then he was axed and career ruined...
At the end of the day as salesperson's of alcoholic beveridges we have to be very careful on what we do, say and promise...
All this has nothing to do with DKAM as they nor Mexcor are a 'retailer store' - to quote the very first line you can see that all these rules pertain to retailers and nowhere does this of course mention distributors:
"[It shall be unlawful …] To induce through any of the following means, any retailer, engaged in the sale of distilled spirits, wine, or malt beverages..."
...when it is Brand to Distributor these rules do not apply...quotas and bonuses can be used effectively inorder to hit the monthly or yearly numbers expected from each brand. There are times when, to name one of many brands we carry, Sam Adams wants us to order in an extra 10 pallets so they can hit their numbers for the PNW - and we can then also hit our numbers for their brand and receive further discounts...
