A gap is a change in the opening price above or below the previous close. So whether or not you want to call it a gap is moot. There was a gap. It doesn't mean it has to be filled, but it likely will get filled eventually, unless upward movement can be maintained before audited financials are released. You don't have to like it, but that's just how these things work more often than not.
