According to the CEO, there was a 1 year restriction on those shares. Part of the deal.....Bottom line is that Kidd doesn't have them:

R. Thomas Kidd canceled the Assignment of Claims executed by the
Company in favor of R. Thomas Kidd on August 26, 2009
