Those are forward looking statements and each and every one of them is qualified by such phrases as "current goal" and "with the intention." To present those as "facts" when there was no intention of presenting as facts, is naive at best and dishonest at worst.

Even the safe harbor statement says that anything not historic is not a fact and is merely intention and goal, which it also says may not be achieved.

The real facts here are that the company is on track to complete tox studies by the end of the year (unless something happens), and following that they will be able to finally file an IND (unless something happens). Those are the facts.
