When you make a statement, EVEN if you have a disclaimer after that statement, you cannot insinuate, infer, promote, or attempt to deceive, if PROVEN the statement, EVEN WITH THE DISCLAIMER, WAS to induce investment. Commonly referred to as "stock fraud" in the industry. And there are a lot of statements in the "gray area", that would require a trial to determine whether the statement made was "gray" or crossed over to "black".

There are damned few investor winners in the "pinks".
