Ahem, you are forgeting that Bush took an oath when he was sworn in as President.

I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States.

I'd have to say Bush did a lousy job protecting them. Would have been nice if he had made public the PDB of August 2001 that he recieved while he was vacationing in Texas.
