ORDER

A scheduling conference was scheduled in this case for November 6, 2009. Defendant's attorney did not appear. The Court ordered the parties to submit a letter concerning the status of the case. A status letter dated November 6, 2009 (0.1. 19) was submitted by the Government stating the parties would file a joint motion for extension of time no later than November 13, 2009. No motion has been filed as of the date of this order.

NOW THEREFORE, IT IS HEREBY ORDERED that:

1) The parties, jointly or separately, shall file a motion to extend time or a status letter no later than November 23, 2009.

2) The time between November 6, 2009 and November 23, 2009 shall be excludable under the Speedy Trial Act in the interests of justice (18 U.S.C. §3161 et seq.)
