I think the approval of a request for an equity committee is a timing issue. If a request is filed to soon, a judge would refuse it because he does not yet have a clear picture of the asset structure of the company. If a request is filed too late, a judge would approve it unless the balance sheet is upside down. However, in this case an equity committee would only have an impact on decisions made late in the game and might miss out on decisions made early in the game that are important for a positive outcome. So, there is an optimal time for such a request, and I think that time is just about now.
