Rules are the rules.

If the defendant doesn't file within 20 days, then the defendant is in default.

After that point, the defendant can file an answer as long as no default has been filed by the plaintiff.

Both parties agreed (see the filing).
But SPNG was in default and was lucky the plaintiff's didn't file a DEFUALT against SPNG.

Those are the facts.
