File the 10K or if it has been submitted (not electronically) for review push to have the SEC give permission to file. due to the investigation they are being extraordinarily cautious, as would we all, prior to releasing any information to the public that did not comply with the issues you are being investigated for. or, they could just arrange a private sale and be done with it all.
