I personally don't believe we should be concerned about this:

"the company either raises more cash or sells itself for less per share than what the group members paid."

Neither of these scenarios occurred. WaMu did not raise more cash on its own and they did not sell themselves. WaMu was seized and sold, they did not engage in this willingly.
