that statement is frought with assumptions...basically the assumption is that the data should be allowed to be entered under argument as the patient has used the product without following the directions on the label.

in that case the efficacy is NEVER expected to adhere to the study

safety is not expected to confrom

and none of the liability issues would likely hold up in court should the patient have not followed the directions on the label.
