Do you believe them about the 3rd party being "prepared to strike" at the end of the 90 days?

They didn’t say that, exactly; rather, CFO Ron Renaud said Idenix was prepared to strike a deal with another company if NVS does not opt-in. That’s a subtle distinction, but I’m sure it was a deliberate.
