I know I posted this yesterday but it's just wonderful listening to the audio so I'm posting again for those who didn't hear it...

I listened to audio, file 20090925 05.mp3 Listen to audio from 9:25 - 12:00 minute mark.. this is where she rules.. I tried to transpose everything she said below....

Judge Walrath says, "The fact that JPMC has continued to appear before me and to continue to proceed with this adversary for the past 4 months... I think evidence is an acknowledgement that really their position is frivolous... Need I say it, I do say it, the argument is frivolous that the collateral order doctrine applies. With respect to the merits of appeal I've already made my ruling on that numerous times I need not to issue it again.. I think that the position of JPMC that I do not have jurisdiction is frivolous.. The adversary proceedings will proceed.. until or unless the appellate court decides otherwise but they need not be held up pending that appeal"....
