I think so. To repeat, I am not sure this suit is a winner but it sure looks good to me. One of the most common malpractice cases against attorneys is for blowing a statute of limitation.

But if the client, MDCO is at fault, then it is not some clerk who failed to do his job that is the ultimate issue. Management has a duty to protect the assets of the company. The bigger the asset, the more significant that duty. This looks like a BIG failure.
