JOINT MOTION TO AMEND ORDER GRANTING DISMISSAL
The Parties, by and through their attorneys, request the Court to amend its order dated
October 19, 2008 wherein the present matter was dismissed with prejudice. The parties hereby
request the order to be amended such that the matter is dismissed without prejudice pending
agreed-upon binding mediation between the parties. In support of their request, the Parties state
as follows:
1. The Parties have agreed to mediate this matter within the next few weeks.
2. The Parties wish to retain their rights to bring certain causes of action either in
federal or in state court should the binding mediation not occur as hoped.
3. The order granting dismissal with prejudice would not allow the parties to bring
such causes of action, and would therefore be prejudicial to the parties.
Wherefore, the Parties request the Court modify its order to grant dismissal of this matter
without prejudice and with leave to reinstate.
