"Production riser buoyancy products
The parties estimate that their combined sales of […]3 in 2001 in Europe and North America represented a share of supply of [60-70 per cent]4 for syntactic foam production riser buoyancy products (increment [less than 5 per cent]5), with competitors Cuming Corporation and Flotation Technologies taking estimated shares of 18 per cent and 10 per cent respectively. Third party comments, however, suggest that the parties may supply in excess of 90 per cent of production riser buoyancy products. This appears to be borne out in the UK where CRP won the majority of contracts each year from 1999 to 2001. Although Balmoral was bidding for contracts during this time, it was unsuccessful in winning any. Nevertheless, the parties argue that four other credible bidders remain in this segment; Cuming Corporation, the parties’ biggest competitor; Flotation Technologies; Resinex and Matrix. Available evidence of bidding history for recent contracts suggests that Balmoral may have been CRP’s closest competitor: but it is difficult to assess whether the loss of Balmoral would be significant. In particular, Cuming Corporation may be able to replace effectively Balmoral as CRP’s main competitor. It has won UK and other contracts and its US plant is sufficiently large to meet all global production riser (and drilling riser) demand alone. Any attempt by CRP to exploit its post-merger position might therefore result in Cuming Coporation winning a greater share of orders. The parties have indeed..
